Mediation and Conflict Resolution
Moxie Inc. provides conflict resolution services to resolve business and interpersonal disputes. We provide mediation in both formal and informal contexts, varying by whether services are provided in a court affiliated manner, or in a pre-legal fashion directed at preventing escalation of the dispute into litigation.
Mediation is an optimal solution for the resolution of disputes when some of the following factors are present:
- There are ongoing or recurring relationships between the parties.
- There is no truly effective legal remedy.
- There are difficult mixed questions of law and fact, or difficulty ascertaining applicable legal standards, making the issue a "legal crapshoot."
- Avoiding the business or personal toll of litigation is important.
- A quick and expedited resolution is mutually advantageous for business or personal reasons, and delay is not to any party's advantage.
- Projected legal expenses approach the amount in controversy.
- Privacy is important.
- The case is so technical or so personally subjective that the court decision-maker is unlikely to be able to make a truly informed decision as to the best outcome of the case.
